Welcome to SnapCar. These Terms of Service ("Terms") govern your access to and use of the SnapCar platform, including our website, mobile applications, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Acceptance of Terms

By creating an account or using the SnapCar Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. You also represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

User Accounts and Responsibilities

To use certain features of our Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • Not share your account credentials with any third party
  • Not create multiple accounts or create accounts on behalf of others

We reserve the right to suspend or terminate your account if we suspect any fraudulent, abusive, or illegal activity.

User Types and Responsibilities

Car Owners

As a car owner listing your vehicle on SnapCar, you agree to:

  • Provide accurate and complete information about your vehicle
  • Ensure your vehicle is properly maintained and safe to operate
  • Maintain valid insurance coverage for your vehicle
  • Comply with all applicable laws and regulations
  • Be available for vehicle handover at the agreed time and location
  • Not list vehicles that are stolen, unsafe, or not legally owned by you
  • Set fair and transparent pricing for your vehicle

Renters

As a renter using SnapCar to book vehicles, you agree to:

  • Possess a valid driver's license and meet minimum age requirements
  • Treat the vehicle with care and return it in the same condition
  • Use the vehicle only for lawful purposes
  • Not smoke in the vehicle unless explicitly permitted by the owner
  • Report any damage or issues to the owner and SnapCar immediately
  • Pay all fees, including rental fees, late fees, and damage fees
  • Return the vehicle on time and to the agreed location
  • Not allow unauthorized drivers to operate the vehicle

Payments and Fees

All payments are processed securely through our third-party payment processors. By using our Service, you agree to:

  • Pay all fees associated with your bookings or listings
  • Provide valid payment information
  • Authorize us to charge your payment method for applicable fees
  • Accept that SnapCar charges a service fee for each transaction (typically 10-15% of the rental price)
  • Be responsible for any taxes applicable to your transactions

Cancellation Policy: Cancellations made more than 48 hours before the rental start time are eligible for a full refund. Cancellations made within 48 hours may incur a cancellation fee. Late returns may result in additional charges.

Refunds: Refunds are processed within 5-10 business days and are subject to our refund policy. Disputes regarding payments should be reported to our support team within 14 days of the transaction.

Insurance and Liability

SnapCar provides insurance coverage for all rentals through our insurance partners, subject to the terms and conditions of the insurance policy. This coverage includes:

  • Liability coverage up to the policy limits
  • Collision and comprehensive coverage for the vehicle
  • Coverage for theft and vandalism

However, you acknowledge that:

  • Insurance may not cover all damages or losses
  • Deductibles may apply
  • Certain activities (e.g., racing, off-roading) may void coverage
  • You may be responsible for damages up to the deductible amount

Car owners are responsible for maintaining their own insurance on their vehicles. SnapCar's insurance is supplemental and does not replace the owner's personal auto insurance.

Prohibited Activities

When using the SnapCar Service, you agree NOT to:

  • Violate any laws, regulations, or third-party rights
  • Use the Service for any illegal or unauthorized purpose
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Post false, misleading, or fraudulent information
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems
  • Scrape or collect user data without permission
  • Use the Service for commercial purposes without our authorization
  • Engage in price manipulation or unfair competition
  • List stolen or damaged vehicles
  • Use vehicles for racing, towing, or other prohibited activities

Violation of these prohibitions may result in immediate suspension or termination of your account and potential legal action.

Intellectual Property Rights

The SnapCar Service and its original content, features, and functionality are owned by SnapCar and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you post to the Service (e.g., vehicle photos, descriptions). However, by posting content, you grant SnapCar a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that content in connection with operating and promoting the Service.

You may not use our trademarks, logos, or branding without our prior written consent.

Dispute Resolution

Disputes Between Users: SnapCar is not a party to disputes between car owners and renters. However, we may assist in facilitating communication and resolution. Users are encouraged to resolve disputes amicably.

Disputes with SnapCar: Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver: You agree to resolve disputes with SnapCar on an individual basis and waive your right to participate in class actions or class arbitrations.

Limitation of Liability

To the maximum extent permitted by law, SnapCar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors or omissions in any content
  • The conduct or content of any third party on the Service

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid to SnapCar in the 12 months preceding the claim.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

SnapCar does not warrant that:

  • The Service will function uninterrupted, secure, or available at any time
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements
  • The quality of any products, services, information obtained through the Service will meet your expectations

Indemnification

You agree to indemnify, defend, and hold harmless SnapCar, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your conduct in connection with the Service
  • Any damage to or loss of any vehicle rented through the Service

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Request by law enforcement or government agencies
  • Extended periods of inactivity

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between you and SnapCar regarding the Service and supersede all prior agreements.
